What is Social Security Disability

Funded by the government, Social Security Disability SSD benefits are designed to help people who are unable to work due to a long-term disability. There are two subsections of Social Security Disability benefits, Social Security Disability Insurance SSDI and Supplemental Security Income SSI, that have their own separate, different requirements. Social Security Disability Insurance is entitlements available for those who are disabled and have earned the minimum amount of work credits required, which come from being in the workforce for about 10 years and have paid into Social Security taxes. Supplemental Security Income is designed to assist low-income disabled people by providing extra money for rent or food. Both programs have very specific and strict requirements but medical eligibility for either is determined through a similar process.

Who Qualifies for Social Security Disability

There are two different ways to qualify for Social Security Disability benefits. The applicant can either prove that they cannot perform substantial gainful activity, or they can prove that they meet one of the severe medical conditions that the Social Security Administration outlines on their website. Proving that the applicant has one of the medical conditions is a more uncommon approach, however, because of the severity of those illnesses. Some of those illnesses are cardiovascular disorders, immune system disorders, mental diseases, malignant neoplastic disorders, respiratory illnesses, HIV, and cancer. For the full list, click here.

Why Are People Denied Social Security Disability

The Social Security Administration holds very high standards, so denials are common. There are a lot of reasons why the SSA would reject an application. The most common reason is there was a lack of supporting evidence in the file, so the SSA couldn’t properly evaluate the claim. Additionally, denials can happen from failure to comply with their doctor’s treatment, continuous drug and alcohol use, participating in fraud, and a condition that lasts less than a year.

A Social Security Disability attorney can tell you what can lead you to a denial. To get in contact with a practiced attorney and have all your questions over the process answered, call Hoglund Law for a free case evaluation.
