A will contains all your instructions in one simple, affordable, and effective document that ensures your wishes are carried out when you pass on. A will is best for families with children or personal property you want to distribute.

Why Do I Need a Trust?

If you have a certain amount of assets when you die, even if you have a will, your estate must go through probate. Probate is a long and expensive process where the courts determine whether your will is valid and where the property will be distributed. With a trust, however, everything you own in trust skips most of the process and can be distributed much faster to your heirs. Additionally, if you are ever incapacitated, a trust can appoint a trusted friend or partner to manage your financial and medical affairs. A trust is best for families who have substantial assets they wish to pass on.

What Debts Can Be Eliminated

Minnesota has an estate tax on property over 3 million dollars, so if you leave a substantial amount of property to your heirs, they will be taxed. Unless, of course, you have an irrevocable trust. An irrevocable trust puts your assets into a trust that pays you income during your life but doesn’t result in a tax burden for your heirs. An irrevocable trust is best for people with large, taxable estates in Minnesota.
