Driving While impaired in Minnesota

In Minnesota, there are four degrees of driving while impaired (DWI). The charges can range from a misdemeanor offense for 4th degree to a felony offense for 1st degree. The punishment imposed is dependent upon the degree and prior convictions or the presence of any aggravating factors.

Violating the DWI Laws in Minnesota Result in Harsh Penalties

If you are found guilty of violating them:

  • Your vehicle could be forfeited
  • You could lose your license
  • Your insurance could increase or be canceled
  • You could face jail time
  • It can affect your ability to get a job

Test Refusal as a result of Driving While Impaired (DWI)

If you refuse to submit to a chemical test when requested by an officer, you face a higher criminal penalty as well as a possible driver’s license revocation for a minimum of 12 months under the Implied Consent Statute 524.10. The penalties are highly complex and have many variables, which is why it’s critical to hire an experienced DWI attorney in Minnesota.

Driving while impaired in Minnesota (DWI)

The legal limit for operating a motor vehicle in the state of Minnesota is under a .08 percent blood-alcohol concentration (BAC). Underage drinking and driving includes any driver younger than 21 years old who has any amount of alcohol within their system (absolute sobriety) while operating a motor vehicle.

Traffic Violation Defense Attorneys

Criminal speeding offenses are considered serious misdemeanor offenses, and they are punishable by higher fines and possible jail time. This is one of the most common traffic violations in Minnesota. Speeding tickets can affect your insurance rates. This could lead up to substantial increases in insurance rates or even cancellation, on top of any court costs, depending upon the amount you were going over the speed limit.

If you have been charged with any of these misdemeanor level offenses, we can help. We also offer a free initial consultation for these offenses.

We handle more than just DWI, we represent clients who have many types of traffic violations including:

  • Moving Violations
  • Misdemeanor Speeding
  • School Bus Stop Arm Violations
  • Driving After Cancellation
  • Driving After Suspension
  • Driving After Revocation
  • Driving Without Insurance
  • Out of Town Cases

Chances are you may be visiting the Twin Cities, or another part of Minnesota and along the way you were pulled over for a traffic violation. Don’t blow this off, it can actually become a problem for you in your home state. Depending on the state in which you live, this could lead to serious repercussions when you go home. You could potentially be facing license suspension or revocation in your home state.
