What is Social Security Disability

A person can receive Social Security Disability Insurance SSDI or Supplemental Security Income SSI if they are unable to work due to a medical condition lasting more than a year. SSDI is available for those that have worked five of the past ten years and given taxes to the Social Security System during that time. SSI is put in place for those of a low-income household.

Who Qualifies for Social Security Disability

To qualify for SSD benefits, an individual must prove they cannot work because of a specific medical condition or they must meet the criteria that the Social Security Administration SSA states.

The SSA lists medical conditions in what’s called the “Listing of Impairments”. If an applicant meets the criteria on the Listing of Impairments, they can be automatically accepted. This is, however, the most uncommon route. Some of the conditions in the Listing of Impairments are immune system disorders, skin disorders, cancer, depression, or musculoskeletal disorders. The full list can be found here.

If you are questioning if you can qualify for Social Security Disability benefits, ask an attorney to discuss your options. At Hoglund Law, we offer free case evaluations. Call to schedule a meeting.

Why Are People Denied Social Security Disability

Applicants can be denied for many different reasons, but the most common reason the Social Security Administration rejects people is because they’re missing strong supporting evidence from their file. Usage of drugs and alcohol, participating in fraud, or a condition lasting longer than 12 months can also lead to a rejection.

It is important to note that denials can happen. If you experience a denial, you can appeal. The SSA gives you a chance to collect the information still needed to properly present your case. Questions are bound to arise during this period. It’s helpful to get in contact with an attorney. They can look through your file and tell you what information would strengthen your claim and what information you’re missing. Hoglund Law offers free case evaluations for people undergoing this difficult process.

Have You Been Denied SSDI / SSI?

Denials are common while applying for benefits but appeals give you a second chance to prove to the SSA that you deserve to be accepted. Requesting an appeal must be done immediately because of the 60-day deadline. The sooner the appeal is requested, the sooner the applicant will get their first check from the SSA if accepted.

Getting all the information required of you is the most important thing to focus on while waiting for the SSA to respond to your appeal. Contacting a Social Security Disability attorney to review your file can be very helpful. They can immediately tell you what you’re missing and what to expect from your claim. During a hearing, having a trusted attorney at your side will give you a better chance at winning. They can provide legal arguments and disprove false assumptions relating to your condition and present supporting evidence in the best way possible.

With a Hoglund Law Social Security Disability attorney, your case won’t be just any case. We’ll work tirelessly to make sure your case is handled properly and with care. Call Hoglund Law for a free case evaluation.
