Anoka County, MN

BANKRUPTCY

Anoka residents need not look further than their own hometown to find the legal counseling that will provide the fresh starts they desire. With extensive expertise in the Bankruptcy Code, our attorneys are equipped with the competencies that are crucial in handling Chapter 13 Bankruptcy, Chapter 7 Bankruptcy, and Debt Settlement. Finding a lawyer capable of directing your Bankruptcy Case to produce a financially free future has never been as refreshingly simple as booking a free 30-45 minute consultation here at Hoglund Law.

CHAPTER 7

If credit card debt, medical bills, or other unsecured debts are the source of your financial trouble, Chapter 7 Bankruptcy could be the path towards your fresh start. If this plan is selected as the most beneficial route to you, filing will result in an automatic stay which bans creditors from collecting or ringing your phone ever again. While the benefits of Chapter 7 are immense, it is not the most desirable option for all, and eligibility requirements can be tricky. Furthermore, if your debts are student loans or child support payments, these debts are not dischargeable, and this path is likely not ideal for you.

To determine if Chapter 7 is capable of providing you with debt relief, it is imperative you consult with a trusted Bankruptcy Lawyer. Navigating the ins and outs of the Minnesota Bankruptcy laws to ensure you receive the best possible outcome is only possible with a qualified lawyer on your side.

CHAPTER 13

Chapter 13 Bankruptcy allows you to pursue financial freedom by making payments to your creditors to a reduced debt through a three to a five-year payment plan. This type of filing is especially perfect for bankruptcy filers who want to safeguard their assets such as their home or car against seizure in Bankruptcy Court.

While Chapter 13 can minimize the disruption to your life, it is not absence of imperfections, and not everyone qualifies. It is essential to understand if this avenue to debt relief is the most advantageous option for you and crucial to begin the filing process if it is. To begin pursuing a course of action and partnering yourself with an ally that will secure you a financially stable future, contact Hoglund Law.

DEBT SETTLEMENT

If you have outstanding personal debt and fail to qualify for bankruptcy, there is no need to worry because debt settlement is still a viable alternative. While this option does not discharge your debt, it almost always results in significantly lowering the total debt you owe. Often referred to as debt negotiation, having stellar legal representation draws creditors to the table for mediation.

Thirty years of experience has allowed our outstanding Bankruptcy Attorneys to understand creditors prefer to negotiate with you instead of you filing for bankruptcy which would result in them receiving no payment. Consequently, your representation will negotiate until a resolution is agreed upon that allows you to make feasible payments on your reduced debt. To obtain an attorney that is well versed in debt settlement and has deep expertise in negotiating, schedule a consultation right here at Hoglund Law.

Social Security Disability ATTORNEY SERVING Anoka

Anoka County, MN

What is Social Security Disability

Meant for those unable to bring in substantial income due to a debilitating condition, Social Security Disability  SSD comes in two forms. The first, Supplemental Security Income SSI is reserved for those in financial need. The second, Social Security Disability insurance SSDI is for the insured who have worked long enough to have paid their way in through Social Security taxes. Filing under neither of these options, however, entitles an applicant to approval. It is only by meeting the medical criteria that an applicant is awarded benefits from the Social Security Administration.

How an Anoka Social Security Disability Attorney Can Help

With over 70 + years of combined Social Security experience, our office is filled with attorneys capable of rooting out holes in your claim and filing them with the medical evidence you possess that will show the Social Security Administration that you are, in fact, unable to work. Further, we offer free case evaluations with no strings attached, meaning that if you are unsure whether you have a claim or simply want amazing legal advice, you can get it at no charge to yourself.

Should you choose to file your claim with the assistance of our experienced attorneys, you will join 30,000 other individuals who have benefited from our assistance and can rest assured that you are in some of the best legal hands.

Who Qualifies for Social Security Disability

To qualify for SSDI you must have worked long enough to have paid into qualifying. This usually amounts to having worked consistently for five of the last ten years, though there are exceptions for those who are under the age off 22 as their parents work credits can count on their behalf. SSI requires that you have less than 3,000 in assets and does not have a work credit requirement as it is not funded by Social Security taxes.

Regardless of which you apply for, however, you must meet certain medical criteria. If you live in Anoka and currently have one of the following conditions, then you qualify for Social Security Disability: multiple sclerosis, cancer, respiratory problems, mental disorders, various syndromes, back disorders, congestive heart failure, etc.

For a fuller list, click here.

It is important to demonstrate that the condition you have meets the medical criteria listed by the Social Security Administration. If you have questions on how to do this, or would like assistance in proving that you have a condition that qualifies, we encourage you to come in for a free case evaluation.

Why Are People Denied Social Security Disability

There are many factors that go into the approval and denial of Social Security Disability applications. Many people are denied on first application due simply to the overwhelming number of applications that roll into the Social Security Administration’s office. There are, however, certain indicators that the administration looks for that can spell automatic disqualification.

If your condition is the result of ongoing drug or alcohol use, for example, the administration will automatically disqualify you on the basis that you would get better if you stopped using. They also do not approve benefits for individuals whose condition isn’t likely to last a full year, i.e. their disability is short-term.

It is best to talk with an attorney to identify what is likely to qualify or disqualify you. If you have any questions pertaining to your specific case, our office offers free case evaluations through which you can start getting your questions answered.

How to apply for Social Security Benefits in Anoka

To apply for Social Security Benefits you will need to gather information that will help the Social Security Administration determine that you qualify. This information should consist of a list of all employers’ contact information, addresses, and names ranging from the last fifteen years; addresses, contact information, and names of doctors, clinics and hospitals that you’ve visited in relation to your condition; and any prescription medication that you’ve taken or are taking in relation to your condition.

If you do not have a thorough list of these things readily available, it is best to apply with what you do have and update later as the information becomes available to you.

Next you will want to either physically go into the closest Social Security Administration office to apply or apply online. The closest physical address to Anoka is 3280 Northway Dr, Brooklyn Center, MN 55429. Most applicants will be denied when first applying and it is important to not be discouraged. Simply appeal the case until the hearing where you will be able to best demonstrate how your disability prevents you from being able to work.

If you would like assistance at any step in the process, Hoglund Law is here to make what can be incredibly difficult slightly easier.

Have You Been Denied SSDI / SSI?

If you’ve been denied SSDI or SSI you might have just fallen victim to having some of your information overlooked or not fully considered. In our experience, many applicants are initially denied upon first applying and even first appeal. It isn’t until someone is able to present evidence of their disability at a hearing that the Social Security Administration is able to clearly see the impact a condition has on an applicant’s ability to work. Further, applicants represented by attorneys have been statistically proven to be more successful. The reason is clear: an experienced Social Security Disability lawyer knows exactly how to argue a client’s situation to the Social Security Administration in the way that gives the client the best shot at being approved.

At Hoglund Law we boast over 70 years of combined experience and have what it takes to fight for you. Applying with us means knowing for certain that your right to a hearing is protected and that you will be in the best possible legal hands.
